How Juror Pay Works under NY Judiciary Law Section 519
New York has some of the strongest juror compensation protections in the United States. Your pay in Brooklyn depends entirely on the size of your company:
- Employers with 11 or more employees: Must pay you at least $40 per day (or your regular salary, if higher) for the first 3 days of your service.
- Employers with 10 or fewer employees: Are not required to pay you. If your employer does not pay, the State of New York will pay you the $40 daily allowance.
- Day 4 and beyond: For all jurors, the State of New York pays $72 per day.
Job Protections
Your employer cannot fire you, demote you, or force you to use your vacation days to cover jury duty. This is illegal under New York state law. However, they are allowed to offset the $40 state allowance from your regular salary if they continue to pay you in full.
Hardship Exemptions
