The Legal Reality for Hourly Workers

The Fair Labor Standards Act (FLSA) dictates federal wage laws. Under the FLSA, employers are not required to pay non-exempt (hourly) employees for hours they did not actually work. Therefore, if you miss a 40-hour week for jury duty, your employer does not legally owe you a dime for those missed shifts.

State-Specific Protections

While federal law won't help you, some states step in. States like New York, Massachusetts, and Colorado require employers to pay your regular wages for the first few days of your service. However, if you live in states like Texas, Florida, or Pennsylvania, your employer is off the hook.

Protecting Your Job

Even if they don't pay you, almost every state has strict laws stating an employer cannot fire, demote, or discipline you for attending jury duty. Furthermore, they cannot force you to use your earned vacation time or PTO to cover the absence, though you may choose to do so to keep your paycheck intact.
