The Power of the CBA

A Collective Bargaining Agreement (CBA) almost always includes provisions for civic duties. In many trades, from manufacturing to teaching to electrical work, the CBA will stipulate that management must make the employee 'whole.' This means the company pays the difference between your regular hourly wage and the meager court stipend.

Check Your Specific Clause

Not all CBAs are created equal. You need to read your contract or speak to your shop steward. Some contracts limit paid jury duty leave to a maximum of 10 or 14 days. If you get stuck on a six-month grand jury, your paid leave might run out, forcing you to rely solely on the court's low daily rate.

Shift Work and Overtime

One common area of dispute is overtime and shift differentials. If you normally work a night shift and get a 15% shift premium, does the company have to pay that premium while you are on daytime jury duty? Your CBA will specifically address this. If management tries to dock your pay unfairly, file a grievance with your rep immediately.
