Independent Contractor Status

The vast majority of real estate agents are 1099 independent contractors hung with a brokerage. Because you are not a W-2 employee, your brokerage does not provide paid time off for jury duty. You will only receive the standard daily rate from the court, which is a fraction of what a single commission check brings in.

Proving Financial Hardship

Courts often view real estate agents as 'business owners.' If you attempt to claim financial hardship, you cannot simply say 'I will lose money.' You must prove that being away from your business for a week or two will cause extreme, unrecoverable financial damage. Providing a letter detailing upcoming mandatory closings or active escrows that require your daily supervision can sometimes persuade a judge to grant a postponement.

Managing Your Clients

If you are seated on a jury, communication is restricted. You must have a backup plan. Partner with another agent in your office to handle your active buyers and supervise your listings while you are in court. Offer to split the commission if they have to step in and save a deal.
